License terms for using Tool'Ami

Tool'Ami grants you a revocable, non-exclusive, non-transferable, limited license to download, install and use the application strictly in accordance with the terms of this Agreement.
You agree not to, and you will not permit others to:
The application, including without limitation all copyrights, patents, trademarks, trade secrets and other intellectual property rights are, and shall remain, the sole and exclusive property of Tool'Ami and its licensors.
The application may collect and use information in accordance with our Privacy Policy. By using the application, you agree to such collection and use.
We may provide updates, patches, or new versions of the application. You agree to install such updates to continue using the service. We reserve the right to discontinue support for older versions.
This license is effective until terminated. Your rights under this license will terminate automatically or otherwise cease to be effective without notice if you fail to comply with any term(s) of this Agreement.
Upon termination, you must cease all use of the application and delete all copies from your devices.
THE APPLICATION IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. TOOL'AMI DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Tool'Ami does not warrant that the application will meet your requirements, be uninterrupted, timely, secure, or error-free.
IN NO EVENT SHALL TOOL'AMI BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OF OR INABILITY TO USE THE APPLICATION.
You agree to indemnify, defend and hold harmless Tool'Ami and its officers, directors, employees, agents, and affiliates from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of this Agreement or your violation of any law or the rights of a third party.
The application may be subject to export laws and regulations. You agree to comply with all applicable export and re-export restrictions and regulations.
If any provision of this Agreement is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
This Agreement constitutes the entire agreement between you and Tool'Ami regarding the use of the application and supersedes all prior and contemporaneous written or oral agreements.
This Agreement shall be governed by and construed in accordance with the laws of the European Union, without regard to its conflict of law provisions.
